| Harvest Time for Como Lake |

Please be advised that Saint Paul Parks and Recreation has contracted with Midwest Weed Harvesting again this year to mechanically harvest aquatic vegetation at Lake Phalen and Lake Como. Many factors have culminated to provide an early bumper crop of aquatic biomass. Our target harvest areas will begin with public, recreational access points. Exact start dates are still tentative and depend on several factors. It is our hope that a harvester will be moored at Lake Phalen as early as Sunday, June 28 and harvesting may begin as early as Monday. A harvesting rig may not be available to harvest at Lake Como until later in the week. I will provide an update as dates and times are firmed up. Please do not hesitate to contact me with further questions.

| Decision in the MGM fence case |

City v. MGM Properties: The Minnesota Court of Appeals issued its decision in the MGM fence case. The Court of Appeals affirmed in part and reversed in part. First, the Court of Appeals affirmed the district court's dismissal of the case, but based the dismissal on different reasons. The appellate court dismissed the case because judicial review of the case was premature due to the fact that MGM failed to exhaust its administrative remedies (i.e., MGM never submitted a site plan application seeking access to the alley) and MGM failed to show that it would have been futile to submit to the administrative process. The appellate court modified the dismissal, however, to make it without prejudice (allowing for the possibility of further enforcement action or litigation of the issues).
